These general conditions apply to orders placed for products available on www.uapparelworld.com
1. PLACING ORDERS ON THE WEBSITE
1.1 How to order
You need an e-mail address to place an order.
Placing an order:
– Find the products you want.
– Add the products to your shopping cart.
– Proceed to checkout.
– Select billing options.
– Review your order.
– Submit your order.
– Receive an online order acknowledgment.
– Receive an online order confirmation.
When you submit an order we will send you an email acknowledging receipt of your order. This does not mean that we have accepted your order. Our acceptance of the order takes place when the Products are shipped to you – we will send you an email confirming that the Products have been shipped (“Order Confirmation”). At this point a contract, containing these general conditions, comes into existence and is binding on you and us (the “Contract”). We recommend that you print or download a copy of these general conditions and the Order Confirmation for future reference.
If we are unable to supply you with a product, we will inform you of this in writing and will not process the order.
1.2 Our right to reject your order or cancel a Contract.
Fulfillment of all orders on the Website is subject to availability. We explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel a Contract by written notice to you in the following situations, without being liable for any damage or costs other than repayment of any amount received from you in relation to the Contract we have cancelled:
– the product is not available / in stock;
– your billing information is not correct or not verifiable;
– your order is flagged up by our security systems as an unusual
order or an order susceptible to fraud;
– your bank transfer payment is not received within 12 calendar days
after acceptance of your order;
– we have reason to believe you are under 16;
– we have reason to believe that you are a reseller;
– there was an error in the price displayed on the Website;
– we could not deliver to the address provided by you;
– due to an Event Outside Our Control
– in the event of misspelling, pricing or other errors or mistakes in
the Website information.
1.3 Data check2
When you send us your order, we may run some checks on it before it is fulfilled. These checks may include verifying your address, creditworthiness, and checking for fraud. As to the latter: we run partly automated checks on all purchases to filter out unusual or suspect transactions, or transactions which can be identified as susceptible to fraud. Suspected fraud on www.uapparelworld.com will be investigated and if necessary prosecuted.
The product prices displayed on the Website are inclusive of UK Value-Added Tax (VAT). Shipping rates are applied per order. The exact shipping rates depend on the country where your order is being delivered to. For details on shipping rates, see shipping information.
The price will be charged in GBP (Great British Pounds).
The total price specified in the final check out screen includes UK tax and shipping costs. This price will be recorded in the Order Confirmation, which we recommend you print or download for future reference. If paying by credit card, the total amount for your entire order will be reflected on your statement in your local currency.
If your local currency is different from the currency in which the prices are quoted, your bank will apply the exchange rate applicable per the date of purchase. Your bank may apply a different exchange rate, which is beyond our control.
2.1 Price Changes
The prices of the products will be as displayed on the Website. Prices may change from time to time, but these changes will not affect any order that has already been placed and the order confirmation email sent.
3. SHIPPING & DELIVERY
All orders are dispatched from the UK within 24 hours of purchasing with the exception of orders made after 14:00am GMT on a Friday through to 8:30am GMT Monday or UK holidays. All orders placed between this period will be dispatched on the first working day afternoon. We deliver products from Monday to Friday. We do not ship on certain public holidays, these holidays will be voiced to our customers before the holiday occurs. We are not liable for possible customs/duties to any other countries other than UK. You might be charged import taxes depending on your own country's rules.
3.1 Estimated Delivery Times
United Kingdom: Next Business Day
European: Most countries Next Business Day, Maximum 2-3 Business days
Rest Of the World: 4-6 Business Days
These orders are estimates, some orders may arrive after the above estimate due to reasons
beyond our control including but not limited to the following:
Issues in customs or with postal service, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, weather, natural disasters, fire, epidemics or failure of public or private telecommunications networks.
3.2 International Delivery Lead Times
Delivery lead times to international addresses will vary according to destination but we will use reasonable endeavors to ensure that all Products will be delivered within 30 days from the conclusion of the contract with us. In the event that your order has been dispatched by us (as confirmed in the dispatch confirmation e-mail) but has not arrived within the estimated delivery time range, please contact our customer services team on the contact details above. Customer Services act on our behalf, and will deal with all queries about the international delivery services.
Depending on stock availability, we may split delivery of your order into several parts and deliver them separately. You will not be charged extra for this. Occasionally, delivery of your order may be delayed or prevented for reasons beyond our control, such as material shortages, import delays or higher than anticipated demand. When delivering outside of the EU, delivery may also be delayed due to customs-related processes (such as inspection). We will use reasonable endeavors to inform you promptly of any such delay. If Products are not delivered within 30 days you may cancel your order and receive a full refund, including all delivery expenses. If delays outside of our control occur, we will make every effort to keep you informed. For the avoidance of doubt, time is not of the essence for the delivery of the Products but you will remain entitled to all statutory rights provided to you by the applicable laws.
4. Intellectual Property Rights
U APPAREL owns all intellectual property rights in the website and in the material published on it. These works are protected by copyright laws worldwide.
Permission is granted to temporarily download one copy of the materials (information or software) on U APPAREL Ltd’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials, use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on U APPAREL Ltd’s website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by U APPAREL Ltd at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
